EKIEKO markets mainly organic food products, natural cosmetics and hygiene and wellness products, selected for their quality and sustainability. For reasons of health and hygiene, foodstuffs, cosmetics and hygiene products may not be returned once unsealed or opened, except in the case of defect or shipping error attributable to EKIEKO.

By accessing or using the Web Site you agree to these Conditions (Use + Contracting). If you do not agree, do not use the Website.

EKIEKO may change these Conditions. If the change is material, we will notify you with at least 30 days in advance. The version in force is the one published on the Web Site at any given time.

1) CONDITIONS OF USE

1.1. Access and rules of use

• Access to the Web Site is free of charge. To purchase or use certain features, you may be required to registration.

1.2. Registration, account and deregistration

• The registration is free and requires accurate and updated data. You must safeguard your credentials. Notify us of any unauthorized use.

• We will be able to suspend or cancel accounts due to fraudulent use, non-compliance, disputes or technical/legal reasons.

• Catalog, product card, shopping cart and online purchase.

• Private area with order history, invoices, addresses, favorites, coupons, communication management.

• EKIEKO may add, change or remove functionalities to improve the experience and security.

2) CONTRACTING CONDITIONS

The contract is formalized in spanish. If you buy from .com, .fr, .de, .it or .pt domains, you will be able to consult informative layers in those languages, but the .com, .fr, .de, .it or .pt version will not be available legally binding is Spanish unless we expressly state otherwise.

2.1. Preliminary information and purchase process

• In each product you will see final price in euros (EUR) with applicable taxes and, prior to payment, the breakdown shipping and handling or other charges.

• The general process is:

2.2. Prices and validity of the offer

2.3. Shipping, lead times and delivery

• We will not ship orders until confirm payment.

• Scope of deliveryWe do not ship to the Canary Islands, Ceuta and Melilla, Portugal (except Madeira and Azores) and the following Euro zone countries: Austria, Belgium, France, Germany, Italy. For other destinations, please contact us before purchasing.

• Primary carrier: GLS will be in charge of all standard shipments.

• For orders for which total weight exceeds 30 kg, the shipping costs will be calculated individually and will be managed through industrial transporter selected by EKIEKO according to destination and logistic conditions.

• Indicative deadlines:
  - Peninsular Spain and Portugal: 3-5 working days.
  - EU: 5-7 working days.
  In any case, the maximum legal deadline for delivery shall be of 30 calendar days from the conclusion of the contract (art. 66 bis TRLGDCU).

• Delivery is deemed to have been made when the carrier places the product at your disposal and you (or an authorized person) sign the reception. Check the package and note incidents visible on the delivery note (e.g. damaged packaging).

• If we are unable to deliver due to shipping information incorrect/incomplete or repeated absence, we may have repercussions forwarding/second delivery charges.

2.4. Shipping costs (according to destination, excluding taxes)

• Peninsular Spain: 7,00 € for orders under 50 €, 0 € from 50 €.

• Balearic Islands: 7,00 € up to 50 €, 0 € from 50 €.

• Germany: 7,50 € up to 79,99 €, 0 € from 80 €.

• Austria: 8,00 € up to 79,99 €, 0 € from 80 €.

• Belgium: 8,00 € up to 79,99 €, 0 € from 80 €.

• France (metropolitan): 7,50 € up to 79,99 €, 0 € from 80 €.

• France (Corsica): 20,00 € up to 149,99 €, 0 € from 150 €.

• Italy: 7,50 € up to 79,99 €, 0 € from 80 €.

• The Netherlands: 8,00 € up to 79,99 €, 0 € from 80 €.

• Luxembourg: 8,00 € up to 79,99 €, 0 € from 80 €.

• Ireland: 12,50 € up to 99,99 €, 0 € from 100 €.

• Finland: 15,00 € up to 149,99 €, 0 € from 150 €.

• Greece: 16,00 € up to 149,99 €, 0 € from 150 €.

• Malta: 17,00 € up to 149,99 €, 0 € from 150 €.

• Cyprus: 17,50 € up to 149,99 €, 0 € from 150 €.

• Slovakia / Slovenia: 10,00 € up to 99,99 €, 0 € from 100 €.

• Estonia / Latvia / Lithuania: 15,00 € up to 149,99 €, 0 € from 150 €.

• Croatia: 10,00 € up to 99,99 €, 0 € from 100 €.

All shipments are sent by GLS. Orders with weight over 30 kg will be calculated individually and will be managed by means of industrial transporter selected by EKIEKO.

2.5. Payment methods, fees and discounts

• Bank transferNo additional charges (processing upon receipt on account).

• Card (Visa, MasterCard, American Express): no additional charges.

• PayPal: no additional charges.

At customized, made-to-measure or custom-made products payPal is not supported.

2.6. Right of withdrawal (consumers)

• You have 14 calendar days from the delivery to withdraw without cause. You can use our Withdrawal Form at the end of this document or write to contact (at) https://ekieko.es/en/ with an unequivocal statement.

• Effects: We will reimburse all payments received, including payments for standard delivery charges, in a maximum of 14 calendar days as soon as you inform us of your decision. We will be able to retain reimbursement until you receive the goods or until you credit the return of the goods.

• Cost of returnUnless we indicate otherwise, the assumed by the consumer.

• Exceptions (art. 103 TRLGDCU), among others: tailor-made or clearly customized goods; goods that can be deteriorate or expire quickly; goods sealed hygiene or cosmetic products that have been unsealed; contents digital not provided on material support when performance has commenced with your express consent, etc.

2.7. Legal guarantee of conformity

• All products are original unless otherwise indicated. Consumer goods have 3-year legal warranty from delivery (art. 120 et seq. TRLGDCU). For goods of second hand the term may be agreed, not less than 1 year.

• During the first two years since delivery, the boasts that the non-conformity already existed, unless there is evidence to the contrary or incompatibility with the nature of the property.

• If the product is not compliant, you can choose between repair or replacement (unless it is impossible or disproportionate). If it is not corrected within a reasonable period of time or with significant inconvenience, you may ask for price reduction o resolution of the contract (the latter will not be applicable if the fault is of minor importance).

• The warranty does not cover damage due to improper use, unauthorized tampering, wear and tear or external causes (shock, humidity, heat, etc.). For perishable/food products, the warranty is limited to their expiration o preferential consumption.

2.8. Customer service and complaints

2.9. Force majeure

• Neither party shall be liable for defaults caused by force majeure (strikes, fires, floods, pandemics, power outages, labor disputes, transportation incidents, logistical blockades, etc.). The obligations are suspend for the duration of the case.

2.10. Assignment

• You may not assign any rights or obligations under an order without consent previous and written by EKIEKO.

2.11. Integrity and modifications

• The invalidity of a clause shall not affect the rest. Any particular condition in writing will prevail on these Conditions as amended.

• Due to technical improvements or changes in availability, EKIEKO can adjust specifications without affecting the value or essential benefits.

3) INTELLECTUAL AND INDUSTRIAL PROPERTY

• EKIEKO is the owner (or the legitimate licensee) of the rights about the Web Site, its design, contents, images, text, trademarks, trade names, databases and codes necessary for its operation.

• You accept a right of use personal, limited and non-exclusive use of the Web Site under these Terms.
