In accordance with the provisions of Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce (LSSI-CE), and in particular Article 10 thereof, this Legal Notice is made available to users.

The access, navigation and use of the website https://ekieko.es, https://ekieko.comhttps://ekieko.fr, https://ekieko.fr, https://ekieko.de, https://ekieko.it and https://ekieko.pt (hereinafter, the "Website") imply the tacit and unreserved acceptance of all the provisions contained in this Legal Notice, having the same validity and effectiveness as any written and signed contract. If the user does not accept the conditions set forth herein, he/she must refrain from accessing or using the Web Site.

1. IDENTIFICATION OF THE OWNER

EKIEKO develops its commercial activity through the online sale of organic food products, natural cosmetics and hygiene and wellness items.

2. OBJECT

This Legal Notice regulates the access, browsing and use of the Website. EKIEKO reserves the right to modify at any time the presentation, configuration and content of the Web Site, as well as the conditions of access or use. Access to or use of the Web Site after such modifications shall imply acceptance of the same.

Certain contents or services may be subject to particular conditions that must be expressly accepted by the User and which shall prevail over the provisions of this Legal Notice in the event of conflict.

3. ACCESS AND USE OF THE WEBSITE

Access to the Website is free and free of charge, without prejudice to the costs of Internet connection to be assumed by the user.

The User agrees to make proper and responsible use of the Website, in accordance with the law, good faith, morality, public order and these conditions. It is forbidden:

  • Use the Website for illicit or unauthorized purposes.

  • Introduce or disseminate computer viruses or any other physical or logical system that may cause damage.

  • Attempt to access, use or manipulate data belonging to EKIEKO or third parties without authorization.

  • Impersonate the identity of other users or EKIEKO.

EKIEKO may deny, suspend or withdraw access to the Web Site to those users who fail to comply with the conditions of use, without prior notice.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All the contents of the Web Site -text, images, photographs, logos, trademarks, graphics, icons, design, software, as well as the source code and structure of the site- are the property of EKIEKO or of third parties who have authorized their use, and are protected by Spanish and European regulations on intellectual and industrial property.

Under no circumstances shall it be understood that access to the Web Site confers on the User any right whatsoever over said contents. The use, reproduction, distribution, public communication or transformation of the contents of the Web Site without the express authorization of EKIEKO is strictly prohibited.

The User undertakes to respect the intellectual and industrial property rights owned by EKIEKO and third parties. It is forbidden to remove or manipulate the copyright notices or protection systems incorporated in the contents.

5. CONTENTS AND LINKS

EKIEKO is not responsible for the contents linked through the Web Site when they belong to third party sites, nor does it guarantee their availability, legality or veracity. In case of detecting illegal content on linked sites, please notify contact (at) ekieko.es to proceed with its removal.

Similarly, links to the Web Site from external sites must comply with the following conditions:

  • They may not reproduce the content of the Website or create frames or similar environments.

  • They may not include false or inaccurate information about EKIEKO.

  • They may not include contents that are illicit, immoral or contrary to public order.

The establishment of a link does not imply the existence of any relationship between EKIEKO and the owner of the website that includes it.

6. EXCLUSION OF LIABILITY

EKIEKO does not guarantee the uninterrupted availability of the Web Site, nor does it accept liability for any possible damage arising from the use or impossibility of use of the same, including technical faults, interruptions of service, viruses or other harmful elements.

Neither shall it be held liable for the use made by users of the content of the Web Site or for the decisions they make based on such information.

EKIEKO has taken all reasonable measures to ensure the correct functioning of the Web Site and to minimize errors, but does not guarantee the total absence of faults or the accuracy of the contents.

7. DATA PROTECTION

The personal data collected through the Website will be treated in accordance with the Privacy Policy available on the Website itself, in accordance with Regulation (EU) 2016/679 (RGPD) and Organic Law 3/2018 (LOPDGDD).

The User must expressly accept said Privacy Policy when providing personal data through the Website.

9. LEGISLATION AND JURISDICTION

This Legal Notice is governed by Spanish law. For any dispute arising from access to or use of the Website, the parties submit to the jurisdiction of the Courts and Tribunals of Madrid (Spain), unless otherwise provided by consumer protection regulations.
